Michael Unnanne (PTY) Ltd (herein referred to as and synonymous with Teta), the owner of Teta, is committed to respecting your privacy and the confidentiality of your personal data, traffic data and communications content. While not exhaustive, the following Terms, Conditions and Policies are designed to assist you in understanding how Michael Unnanne (PTY) Ltd uses and safeguards the information you provide in subscribing for and using Teta’s voice, video and chat communications services and/or Michael Unnanne (PTY) Ltd’s products.

TRADE MARKS, LOGOS AND COPY RIGHTS

All trademarks and logos appearing on the Teta website and mobile app are the sole property of the respective entities and their mention and/or display in the Teta website and/or mobile app in no way constitutes an endorsement, affiliation, or representation of any sort in any form by Teta or between Teta and the respective owners and entities.

USAGE COST IMPLICATIONS

Please note that while Teta Mobile Instant Messaging services are designed to result in a ZERO data or airtime cost to yourself when used on participating mobile networks, downloading the Teta mobile app and updating Teta results in a data charge at either in/out of bundle data rates as applicable. Participating mobile networks will be announced through public channels and via system wide messages in Teta.

Please also note that you will need to have either a valid Free/Promotional/Prepaid/Postpaid SMS bundle or sufficient airtime to send a single SMS at respective ordinary rates in order to complete your mobile number verification during Account Registration.

1. WHAT INFORMATION DOES Teta COLLECT AND USE?

Teta may gather and use information about you, including (but not limited to) information in the following categories:

(a) Identification data (e.g. name, town or city, mobile number, email address);

(b) Profile information (e.g. age, gender, country of residence);

(c) Internet session identification data (e.g. IP address, SIM Serial);

(d) Call quality, competition and survey results;

(e) Information about your usage of Teta and interaction with the Teta services, and client microsites (including mobile OS platform, mobile device, mobile network and connection information, Teta app performance information, Teta app error reports, device capability, bandwidth and traffic to and from our servers and usage statistics;

(f) Correspondence between you and Teta;

(g) Location information, derived from your mobile carrier or from your mobile device for delivery of relevant, location based content;

(h) Mobile device information, such as manufacturer’s name, device model number, operating system, mobile carrier network and connected Wi-Fi SSID.

2. HOW DOES Teta USE THIS INFORMATION AND FOR WHAT PURPOSE?

Our primary purpose in collecting information is to provide you with an enjoyable, safe, smooth, engaging, and tailored experience. Teta collects and uses personal data relating to you, as permitted or necessary to:

  • provide commercial communications by means of the Teta system and/or the Teta products;
  • automatically connect you to participating Wi-Fi HotSpots for location based app features;
  • provide other services for you (as described when we collect the information);
  • connect you with relevant opportunities, products and services in your area;
  • assist you in linking up with people of similar interests in your area upon your prompting;
  • provide you with customer support and troubleshoot problems;
  • compare information for accuracy and inform you about service updates and faults;
  • request feedback or participation through in-app/in-ad surveys;
  • resolve disputes;
  • verify your identity to protect you from activities potentially linked to Identity Fraud in Teta;
  • customize, measure, and improve Teta systems performance, as well as other Teta products and services
  • organise and carry out Teta’s marketing or promotional operations/offers, contests, games and similar activities that are of interest to you as an individual; and
  • protect your and Teta’s interests.

3. DISCLOSURE OF YOUR PERSONAL INFORMATION

Except as provided below, Teta will not sell, rent, trade or otherwise transfer any personal and/or traffic data or communications content outside of Teta and its controlled subsidiaries and affiliates without your explicit permission, unless it is obliged to do so under applicable laws and by legal order of a competent court with relevant jurisdiction. Please note that information that you voluntarily make public in your user profile, or which you disclose in Teta chat rooms will be publicly available and viewable by others.

Teta may disclose your personal information to appropriately respond to legal actions, exercise our legal rights or defend against legal claims, to protect Teta’s interests, fight against criminal/questionable activity within Teta, fraud and to enforce our policies or to protect anyone’s rights, property, or safety.

In order to provide you with Teta products you have requested, Teta may sometimes, if necessary, use non personally identifiable information for example to assist third party banking organizations, Financial Service Providers or other providers of funding, Human Resources agencies, analytical services, advertisers, customer support, or hosting services provide highy relevant and strategic services via the Teta services system. Teta will never issue these entities a copy of our subscriber database, in whole or in part.

Some Teta products may be co-branded and offered together with or via a partner company. If you register for or use such products, you consent to both Teta and the partner company’s use of personal data collected in connection with the co-branded product. Teta may offer its products in connection with other websites or services or may team with other online services to give you the combined results of both products/services or additional services and benefits. To determine whether you would benefit from the combined offer, if you have provided your consent, Teta may match your mobile number as well as email address, against details you have provided to the third party website/service provider.

If you are an ADVERTISER on Teta, detailed information about the activity on your Teta account including traffic data and details of your purchases and uploads can and will be accessed by your Teta Account Manager in the process of performing duties relevant to industry regulatory compliance as well as Teta’s contractual and legal obligations.

Teta, Teta’s local partners, or the operators or companies facilitating your communication may provide personal data, communications content and/or traffic data to an appropriate judicial, law enforcement or government authority with jurisdiction lawfully requesting such information. You hereby consent to such lawful disclosure.

Information you generate that is collected by or sent to Teta will be stored and processed in the Republic of South Africa or any other country in which Michael Unnanne and/or its affiliates, subsidiaries, or service providers maintain facilities. In this regard, and/or for purposes of sharing or disclosing data in accordance with this section 3, Teta reserves the right to transfer this information outside of your country of residence. By using Teta services, Teta’s websites or Teta products you consent to any such transfer and storage of said information outside of your country of residence.

As Michael Unnanne (PTY) Ltd continues to develop its business, the same might sell/buy subsidiaries and/or business units. In any such transactions in which Michael Unnanne (PTY) Ltd or substantially all of its assets are acquired by a third party, personal information of Teta users will naturally be one of the transferred business assets. We fully reserve the right to include your personal information in any such ownership transfer.

4 ADVERTISING

The advertisements of third parties appearing on the Teta mobile app, website and products are delivered to you by Teta.

Teta will use information that you have provided in your Teta profile or otherwise provided to Teta, such as your age, gender, language and city of residence, as well as information about your relationship with Teta’s products, in order to deliver advertisements likely to be of greatest interest to you and to help us measure and improve the performance of our clients’ advertising campaigns.

All adverts displayed on Teta are screened for content quality and standards compliance.

It is not possible to subscribe to Teta and not receive ads.

5. YOUR USER PROFILE

Your user profile is the information provided by you at registration or later. It will include your first name, mobile number, gender, age, country, employment status and any other information that you decide to make available. You can access your user profile from the Teta mobile app in order to view or correct this information at your leisure.

6. LINKED WEBSITES AND THIRD PARTY APPLICATIONS

Teta third party adverts may contain links that might cause you to leave Teta’s mobile app and access the respective website via your mobile internet browser. This will ALWAYS result in a data or airtime charge and such browsing is NOT covered by Teta’s free service. Linked websites are not under the control of Teta and these websites have different privacy policies. The Teta Privacy Policy applies solely to personal information that is acquired on Teta, Teta products and/or your relationship with Teta, so Teta urges you to be careful when you enter any personal information online. Teta accepts no responsibility or liability for these other websites.

If you use any extras, plug-ins or third party applications together with your Mobile Internet Browser, the provider of such applications may obtain access to certain personal information about you. Teta does not and cannot control how the provider of applications may use any personal information connected in connection with such applications. Please ensure that you review any privacy policies or other terms applicable to the use of such application before installation.

7. HOW DOES Teta PROTECT YOUR PERSONAL INFORMATION?

Teta will take appropriate organizational and technical measures to encrypt and protect your personal and chat data with due observance of the applicable obligations, legislation and exceptions in compliance with relevant law.

8. CONTACTING YOU

Teta may from time to time ask you to provide information on your experiences which will be used to measure and improve quality. You are at no time under any obligation to provide any of such data. Any and all information which is voluntarily submitted in feedback forms within the Teta mobile app or any survey that you take part in is used for the purposes of reviewing and improving the Teta service, and Teta and other Michael Unnanne (PTY) Ltd products and services.

Teta may contact you to send you messages about faults and service issues. Further to this, Teta reserves the right to use email or SMS to notify you of any eventual claims related to your use of Teta service and/or Teta products, including without limitation claims of violation of third party rights.

If you have registered for or use co-branded Teta products/services; the emails, IMs or SMS that you receive may be from our partner company, acting on Teta’s behalf.

9. HOW CAN YOU ACCESS OR AMEND YOUR PERSONAL DATA?

You have the legal right to view, access and where relevant, to amend your personal information. Your information may be viewed or edited in-app by using the ‘Edit Profile’ link in your profile page (pencil icon in the top right-hand corner). Teta will use all reasonable endeavours to accommodate requests to delete personal information unless it is required to be retained by law or for lawful business purposes.

10. HOW LONG IS YOUR PERSONAL DATA KEPT BY Teta?

Teta will retain your information for as long as is necessary to:

(1) fulfill any of the Purposes (as defined in Section 2 of these Terms and Policies) or

(2) comply with applicable legislation, regulatory requests and relevant orders from competent courts.

Teta will take appropriate technical and security measures to protect your information. By using this service, you consent to the storage of your system usage statistics as described above.

11. LIMITATION OF LEGAL LIABILITY

IT IS A PARENT’S/LEGAL GUARDIAN’S SOLE AND INALIENABLE RESPONSIBILITY TO ENSURE AND ENFORCE THEIR OWN MINOR CHILD’S/WARD’S SAFETY ONLINE AT ALL TIMES!

Teta strongly insists that parents be vigilant at all times and to always be involved in ALL online activities of their minor children/wards to ensure that no contact is made with any child without parental knowledge/approval/consent/permission and to help their minor dependants correctly deal with and navigate away from negative/dangerous situations while instructing them clearly of the dangers of online activities.

The Teta mobile app and services are NOT intended for nor designed for use by subscribers under the age of 13.

By subscribing to and using the Teta service, you confirm that you are either above the age of 18 or have received explicit permission from your parent or guardian to subscribe to and use this service and you (if 18 years or older in age) and/or your parent/guardian (if you are below the age of 18) tacitly agree to be legally bound by these Terms and Policies and unreservedly agree to hold harmless Michael Unnanne (PTY) Ltd, its affiliates and its and their respective owners, investors, contractors, officers, directors, members, managers, partners, shareholders, licensors, suppliers, customers, employees, agents, third-party advertisers, counselling, technology and service providers from and against any loss, damage, cost, or liability (including, attorneys’ fees) resulting from or relating in any way to any claim, demand, action or proceeding that arises out of the offerings and operations of Michael Unnanne (PTY) Ltd, including but not limited to in relation to: (a) the use, non-use or misuse of, or connection to the Teta service, the services and any content (including without limitation your content and any third party content) forming part of the Teta service offering.

Regardless of what ever efforts Michael Unnanne (PTY) Ltd may make to protect your privacy and communication, Michael Unnanne (PTY) Ltd makes no guarantees of safety or protection from harm on its service and as such accepts no responsibility what so ever, under any circumstances, for any personal injury, financial gains and losses, emotional, psychological or medical injury, religious and social injustice, racial and sexual bigotry and abuse, victimization, asset/business/Intellectual Property damage/loss, Copy Right infringement and/or loss of life – wrongful or otherwise, directly or indirectly resulting from the use of Teta and shall not entertain any discussions, legal or otherwise, there into ad infinitum.

12. CAN THIS PRIVACY POLICY BE MODIFIED?

Michael Unnanne (PTY) Ltd will occasionally update these Terms and Policies to reflect changes in our services and/or products and customer feedback. When we post changes to these Terms and Policies, we will update the last revised date at the bottom of the page. If there are material changes to these Terms and Policies or in how we will use your personal information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending a system wide notification via Instant Message. You agree that your continued use of the Teta5 app, Teta system and/or Teta products after such notification shall constitute your acceptance of said changes. We encourage you to periodically review these Terms and Policies to correctly understand of how Teta is collecting, using, and protecting your information.
